If you are a consumer located within the European Economic Area, you may also have the right to bring proceedings before the courts of your country of habitual residence. Nothing in these Terms affects your statutory rights as a consumer under applicable law.

Dispute Resolution

We commit to responding to any complaint within ten (10) business days and will work in good faith to reach a mutually satisfactory resolution.

If the dispute cannot be resolved informally within thirty (30) calendar days of your initial written notice, either party may pursue formal resolution. For disputes not involving consumer statutory rights, both parties agree to submit the dispute to binding arbitration administered by the London Court of International Arbitration (LCIA) under its arbitration rules in force at the time of the dispute. The arbitration shall be conducted in London, England, in the English language, and the arbitrator's decision shall be final and binding.

Nothing in this section prevents either party from seeking interim or injunctive relief from a court of competent jurisdiction where necessary to protect intellectual property rights or prevent irreparable harm. If you are a consumer, this section does not affect your right to bring a claim before the competent courts as described in Section 10 above, or to make use of any applicable alternative dispute resolution (ADR) scheme.

Termination

CapitalFlow reserves the right to suspend, restrict, or terminate your access to the Website and Services, in whole or in part, at any time and for any reason, including but not limited to:

  • Engaging in fraudulent, abusive, or illegal activity
  • Providing false or misleading information during registration or use of the Services
  • Non-payment of fees for paid Services (following a reasonable notice period of at least 7 days)
  • Requests by law enforcement or other government agencies

You may terminate your relationship with CapitalFlow at any time by discontinuing use of the Website and Services. We will process your request within thirty (30) days, subject to any legal obligations requiring us to retain certain data.

Additional Provisions

Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
